General Terms and Conditions: COURSE

1. SCOPE OF APPLICATION, AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

   1.1 These General Terms and Conditions (hereinafter “GTC”) govern the legal relationship between db pottery studio GmbH, Schiffbaustrasse 9a, 8005 Zurich (hereinafter “db pottery studio”), and the participants (hereinafter “Participant”) of pottery workshops organised by db pottery studio (together referred to as the “Parties”).
   
   1.2 Deviating or supplementary provisions shall only apply if explicitly agreed in writing by db pottery studio and shall only be valid for the specific individual case. In case of doubt, these GTC shall prevail.
   
   1.3 All forms of communication that enable written proof, such as e-mail (denise@db-pottery.ch), shall be deemed equivalent to the written form.

2. REGISTRATION AND PAYMENT

   2.1 Registration for all workshops is binding and must be completed via the official booking platform on the website (www.db-pottery.ch). Spontaneous participation (drop-ins) is not permitted.
   
   2.2 The Participant’s spot in a workshop is confirmed only upon receipt of full payment.
   
   2.3 By registering for a workshop, the Participant acknowledges and accepts these GTC.

3. KURSARTEN UND NIVEAUS

   3.1 Workshops may vary in duration and format. All details regarding schedule, content, instructors, and age suitability are specified in the workshop description on the website.
   
   3.2 Unless otherwise stated in the workshop description, all workshops are suitable for all levels.

4. AGE REQUIREMENTS

   4.1 Unless otherwise specified, pottery classes are suitable for participants aged 16 years and older.

   4.2 Separate classes are offered specifically for children and teenagers aged 8 to 16 years (“Kids’ Classes”). Participation in these classes is restricted to the stated age group.
   
   4.3 db pottery studio reserves the right to request proof of age and to decline participation if the age requirements are not met.

5.  MATERIALS

   5.1 Alle Materialien (Ton, Glasuren, Werkzeuge etc.) sind, sofern in der Kursbeschreibung nicht anders angegeben, im Kurspreis inbegriffen.

6.  CANCELLATIONS AND REFUNDS

   6.1 Stornierung durch den Teilnehmer
   
   Workshops in general:
   

   - Free cancellation up to 14 days before the start of the workshop.
   - Cancellation between 7 and 14 days before the start is subject to an administrative fee of CHF 50.
   - No refunds will be issued for cancellations within 7 days before the workshop or after it has started.

   Workshop which require more organisation an preparation (this incl. all workshops held by guest mentors, all our regular Intensecourses and Intenseweeks):
   
   - Free cancellation up to 6 weeks before the start of the workshop.
   - Cancellation between 4 and 6 weeks before the start is subject to an administrative fee of CHF 50.
   - No refunds will be issued for cancellations within 4 weeks before the workshop or after it has started.

   6.2 Stornierung durch db pottery studio
   If a workshop is cancelled by db pottery studio, the course fee will be refunded in full. No further claims shall be accepted.

   6.3 Ersatzperson
   The Participant may appoint a substitute to take their place in the workshop. Notification must be sent in advance to db pottery studio via e-mail with the full name and contact details of the substitute.

7. MODIFICATIONS TO WORKSHOPS

   7.1 db pottery studio behält sich das Recht vor, Änderungen im Kursinhalt, bei Kursleitenden, Zeiten oder dem Kursort vorzunehmen. Solche Änderungen werden den Teilnehmern rechtzeitig mitgeteilt.

8. BEHAVIOUR AND STUDIO REGULATIONS

   8.1 Teilnehmer müssen das Studio, die Ausstattung, das Personal sowie andere Teilnehmer jederzeit respektvoll behandeln.

   8.2 Im Studio und direkt am Eingang ist das Rauchen strengstens verboten.

   8.3 Hunde sind nicht erlaubt, sofern nichts anderes mit der Studioleitung vereinbart wurde.

   8.4 db pottery studio behält sich das Recht vor, Teilnehmer bei unangemessenem oder unsicherem Verhalten ohne Rückerstattung vom Kurs auszuschließen.

9. LIABILITY

   9.1 Die Teilnahme an den Kursen erfolgt auf eigenes Risiko. db pottery studio lehnt jegliche Haftung im gesetzlich zulässigen Rahmen für Verletzungen oder Schäden ab, die durch die Nutzung der Ausrüstung oder Teilnahme am Kurs entstehen.

   9.2 Der Teilnehmer ist selbst für eine ausreichende Unfall- und Haftpflichtversicherung verantwortlich.

   9.3 db pottery studio haftet nicht für Diebstahl, Verlust oder Beschädigung persönlicher Gegenstände.

10. PARTIAL VALIDITY / APPLICABLE LAW AND PLACE OF JURISDICTION

    10.1 Sollte eine Bestimmung dieser AGB ganz oder teilweise unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Die unwirksame Bestimmung wird durch eine rechtlich wirksame ersetzt, die dem angestrebten Zweck am nächsten kommt.

    10.2 Diese AGB sowie alle damit zusammenhängenden Rechtsfragen unterstehen ausschließlich dem schweizerischen Recht. Ausschließlicher Gerichtsstand ist Zürich.
