General Terms and Conditions of the contract and travel of db pottery studio GmbH

  1. Subject of the contract

1.1 These conditions regulate the legal relationship between the participant and db pottery for the retreat offered by db pottery and its services.

  1. Conclusion of the contract

2.1 The contract is concluded when the participant confirms this through the website. From this point on, all rights and obligations are binding for both the participant and db pottery.

  1. Services

The services are outlined in the description on the website. Special requests or side agreements made by the participant are only binding if they are confirmed in writing by the booking office. The participant is responsible for their arrival and for arriving on time.

  1. Prices and payment terms

4.1 The prices for the retreats are listed on the website and are per person in Swiss Francs. After booking, the participation fee must be transferred within 7 days.

4.2 If the payment is not received on time, db pottery will send a one-time reminder before the booking is considered canceled.

  1. Changes or cancellation of the registration

5.1 If the participant needs to change or cancel their participation, this must be communicated in writing via email.

5.2 A cancellation fee of CHF 100 will be charged, which is not covered by cancellation insurance.

5.3 In the case of a cancellation, no costs will be refunded. However, with the submission of a doctor's note, partial or full reimbursement through cancellation insurance is possible.

5.4 Insurance is not included; the participant is responsible for arranging it independently if needed.

5.5Vaccination or testing requirements may apply in the destination area for participation; if these requirements are not met, the regular cancellation conditions will apply.

  1. Program and price changes

6.1 db pottery reserves the right to adjust service descriptions and prices before a participant's booking..

6.2 In exceptional cases, the agreed price may need to be adjusted after the contract has been concluded, for example, due to exchange rate changes or government-mandated price increases (such as VAT). If the cost of a trip increases due to a low number of participants, these additional costs may be passed on to the participant, resulting in an increase in the travel price.

6.3 db pottery reserves the right, in the interest of all participants, to change the program or individual services (such as accommodation or workshops) if unforeseeable or unavoidable circumstances make this necessary. In such cases, db pottery will make every effort to offer the participant equivalent substitute services. However, db pottery is not liable for program changes caused by force majeure or government measures. The participant will be informed of such changes and their impact on the price as soon as possible.

  1. Cancellation of the retreat by db pottery

7.1 db pottery is entitled to cancel the retreat if a participant gives cause for it through their own behavior or omission. In this case, the participant will be refunded the already paid travel price; however, further claims are excluded. Cancellation costs according to points 5.2 and 5.3, as well as potential claims for damages by db pottery, remain reserved.

7.2 All retreats have a minimum number of participants, which is specified in the description. If fewer participants than expected sign up, db pottery may cancel the retreat no later than 22 days before the planned start. However, if the retreat is still held with fewer participants, this is not a valid reason for cancellation.

7.3  Force majeure events (e.g., natural disasters, epidemics, unrest), government measures, or strikes may lead db pottery to cancel the trip. In such a case, the participant will be informed as quickly as possible. For the work already performed, db pottery may charge a processing fee of CHF 100 per person, as the cancellation is caused by uncontrollable factors..

7.4 db pottery reserves the right to cancel the trip for other reasons as well. In this case, the participant will be informed immediately.

  1. Program changes, service cancellations during the trip

8.1 If a program change becomes necessary during the retreat (e.g., due to weather conditions) that affects a significant part of the agreed retreat program, db pottery may refund the participant the difference between the agreed travel price and the value of the services provided.

8.2 If the chosen level of service is too high for the participant, db pottery will make an effort to offer an alternative program. Any additional costs will be borne by the participant.

  1. If the participant starts the retreat but is unable to complete it

9.1 If the participant has to cancel the retreat prematurely for any reason, the price for the arrangement unfortunately cannot be refunded. Unused services will be refunded, minus a reasonable processing fee, provided they are not charged to db pottery. In urgent cases (such as personal illness, accident, or the serious illness or death of a close relative), the course management on-site or the service provider will assist the participant, as far as possible, in organizing their return journey.

  1. If the participant has a complaint

10.1 If the trip does not proceed as contractually agreed or if damage occurs, the participant is obliged to report this immediately – preferably on the same day – to the db pottery course management, the local db pottery representative, or directly to the service provider and request a free remedy.

10.2 The course management or service provider will strive to offer a solution within 48 hours. If no remedy is provided within this period or the solution is insufficient, the participant should have the defect or damage confirmed in writing by the course management or service provider. They are obligated to document the incident and the complaint in writing. However, the participant is not authorized to directly acknowledge any claims for compensation. If it is not possible to reach the db pottery course management, the local representative, or the service provider, the participant may contact db pottery directly.

10.3 If the participant wishes to make a complaint, request a refund, or claim compensation from db pottery, the complaint must be submitted in writing within 30 days of returning. The confirmation from the service provider and any relevant evidence should be included.

  1. Obligations of the participants to cooperate

11.1 The trip management may exclude participants who significantly disturb the group or do not follow the rules from further participation. In this case, any return travel costs are to be borne by the participant, and the travel price will not be refunded.

11.2 Good health is required for participation in the db pottery trips. If a participant does not meet the health requirements, we kindly ask them to inform us.

  1. Liability of db pottery

12.1 db pottery will reimburse the value of agreed-upon but not provided or poorly provided services, or additional expenses incurred by the participant, provided that it was not possible on-site to offer an equivalent substitute service.

12.2 Exclusions and limitations of liability

12.2.1 db pottery accepts no liability if the non-fulfillment or inadequate fulfillment of the contract is due to the following causes:
a) due to omissions by the participant before or during the trip;
b) due to unforeseeable or unavoidable omissions by third parties not involved in providing the contractually agreed services;
c) due to force majeure, weather conditions, or events that db pottery, the intermediary, or the service provider could not foresee or prevent despite exercising due diligence. In such cases, db pottery accepts no liability.

12.2.2 db pottery is liable for personal injuries (death, bodily injury, illness) due to non-fulfillment or inadequate fulfillment of the contract, provided the damages were caused by db pottery or its service providers. However, international agreements and national laws apply.

12.2.3 In the case of property and financial damage resulting from non-fulfillment or inadequate fulfillment of the contract, db pottery's liability is limited to a maximum of twice the travel price, unless international agreements or national laws stipulate otherwise.

  1. Entry and visa requirements

13.1 All information regarding passport and entry requirements applies to citizens of Switzerland. Citizens of other countries, including Germany and Austria, should refer to the respective detailed program for the regulations. Other nationals should consult their booking office or the relevant consulate for information.

13.2 The participant is responsible for obtaining valid travel documents or visas in a timely manner. If a travel document is not available or is issued too late, resulting in the cancellation of the trip, the cancellation terms according to clause 5 will apply.

13.3 Travelers are responsible for complying with all entry, health, and currency regulations. It is important to check before departure that all necessary documents are complete.

13.4 If a participant is denied entry, they will be responsible for the return travel costs. db pottery also points out that all legal consequences of importing prohibited goods will be borne by the travelers.

  1. Reconfirmation of flight tickets

14.1 For individually booked trips, the participant is responsible for reconfirming their return flight if required. Failure to reconfirm may result in the loss of transport entitlement, and any additional costs will be borne by the participant.

  1. Data protection

15.1 db pottery requires certain data from all travelers (e.g., name, date of birth, address) for the correct processing of the contract and is subject to Swiss data protection laws. All data is securely stored and protected.

15.2 As far as necessary for the contract processing, the data will be forwarded to service providers in Switzerland or abroad, where different data protection standards may apply. In certain cases, this data may be shared with authorities due to legal requirements.

15.3 Depending on the booked offer, sensitive data may be required. For example, food preferences may reveal information about religious affiliation. By providing such information, the participant expressly consents to its use in accordance with these data protection provisions.

15.4 db pottery reserves the right to inform participants about future programs and trips. This service can be unsubscribed from at any time. Furthermore, data may be shared with authorities and third parties in order to enforce legitimate interests.

  1. Applicable law and jurisdiction

16.1 Swiss law applies to the legal relationship between the participant and db pottery. If individual provisions of the travel contract are invalid, the rest of the contract remains in effect.
